We Defend EU – Diaspora / Commercial Division
Prepare to negotiate.
Define a workable outcome.
Commercial mediation needs a clear mandate, a reliable factual record and realistic settlement priorities. We support the preparation and agreed workstreams around a structured negotiation.
01 / The commercial question
Make the settlement discussion purposeful.
A cross-border dispute may affect future supply, cash flow or an important business relationship. Mediation preparation brings those practical concerns together with the disputed obligations, the evidence and the authority needed to explore a resolution.
This service is for businesses and instructing firms considering or preparing for mediation. The role is agreed explicitly: preparation or support for a party is distinct from acting as an independent mediator. No neutral appointment is implied by an enquiry.
02 / Defined workstreams
A focused scope.
Useful deliverables.
Objectives and authority
Identify the interests to protect, the business constraints, the decision-makers and the authority required to negotiate and approve terms.
Position and evidence
Organise the chronology, contract provisions and key documents. Develop a concise issues list and, where instructed, draft position materials for review.
Settlement structure
Explore the components of a workable proposal: payment, timing, ongoing performance, releases and implementation. Flag jurisdiction-specific questions for the appropriate advisers.
Preparation and follow-through
Agree the preparation timetable, participants, communication responsibilities and post-session actions. Any settlement drafting or enforcement advice receives a separate, express scope.
What the assignment can deliver
The brief may include a preparation memorandum, evidence pack, draft position statement or settlement-issues checklist. Confidentiality arrangements, participation, review responsibility and fees are agreed before work begins.
03 / Engagement
Assessment.
Briefing. Proposal.
Assess suitability
Explain the dispute, the parties, the countries involved and whether mediation is being considered or already arranged.
Prepare the mandate
Define the materials, objectives, authority and output needed for the discussion.
Scope the next stage
Agree any session support or further drafting separately from the preparation assignment.
Suitable enquiries are invited to a private, no-charge 20-minute corporate briefing. Substantive work begins only after scope, responsibility and fees are agreed.
Will the other party have to settle?
No settlement outcome is promised. The process and any binding arrangements depend on the parties, the applicable framework and the terms agreed.
Are you acting as the neutral mediator?
Only if a separate neutral appointment is expressly agreed and suitable. This page primarily describes preparation and support workstreams.
Your next step
Bring the decision
into focus.
Tell us your organisation, the jurisdictions involved, your commercial objective and any urgent date. We will review suitability before inviting you to a corporate briefing.
Please use a brief overview at this stage. Document-transfer arrangements and any engagement are confirmed separately.
